1. Acceptance of Terms

By accessing or using WhimCanvas (operated by Blackweight Intelligence), you confirm that you are at least 16 years old, have read and understood these Terms & Conditions, and agree to be legally bound by them. If you are using WhimCanvas on behalf of an organisation, you represent that you have authority to bind that organisation to these terms.

2. Description of Service

Whim Canvas is an all-in-one workspace management tool that combines Kanban boards, calendar planning, team chat, video calls, file storage, AI assistance, and board insights in one focused workspace. It is designed for startups, freelance teams, and student groups.

We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice where practicable.

3. Accounts & Registration

You must create an account to use WhimCanvas. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

• You are responsible for maintaining the confidentiality of your credentials.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately of any unauthorised access to your account.
• One person or entity may not maintain more than one free account.

4. Acceptable Use

You agree not to use WhimCanvas to:

• Violate any applicable laws or regulations.
• Infringe on any third party's intellectual property or privacy rights.
• Transmit malware, viruses, or other malicious code.
• Attempt to gain unauthorised access to our systems or other users' accounts.
• Engage in scraping, crawling, or automated data extraction without permission.
• Send spam or unsolicited communications through the platform.
• Impersonate another person or entity.
• Harass, abuse, or harm other users.

We reserve the right to suspend or terminate accounts that violate these restrictions.

5. Intellectual Property

Our IP: WhimCanvas, its logo, design, software, and all associated content are owned by Blackweight Intelligence and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written consent.

Your IP: You retain full ownership of all content you create, upload, or store within WhimCanvas. By using the service, you grant us a limited licence to host, display, and process your content solely for the purpose of providing the service to you.

6. Your Data

We take the security and privacy of your data seriously. Please review our Privacy Policy for full details on how we collect, use, and protect your information.

You may export or delete your data at any time from your account settings. Upon account termination, your data will be retained for 30 days before permanent deletion, unless legal obligations require otherwise.

7. Payment & Billing

Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except where required by law or explicitly stated in our refund policy.

• Prices are subject to change with at least 30 days' notice for existing subscribers.
• Failure to pay may result in suspension or downgrade of your account.
• You are responsible for all applicable taxes in your jurisdiction.

8. Termination

You may cancel your account at any time from your account settings. We may suspend or terminate your account if you violate these terms, with or without notice depending on the severity of the violation.

Upon termination, your right to use the service ceases immediately. Sections relating to intellectual property, disclaimers, liability, and governing law survive termination.

9. Disclaimers

WhimCanvas is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee that the service will be uninterrupted, error-free, or that any defects will be corrected. We are not responsible for any loss of data resulting from service interruptions.

10. Limitation of Liability

To the fullest extent permitted by law, Blackweight Intelligence shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or business interruption, arising out of or in connection with your use of WhimCanvas.

Our total liability to you for any claim arising from these terms or your use of the service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Changes to Terms

We may update these Terms & Conditions from time to time. We will notify you of material changes via email or a prominent notice within the product at least 14 days before changes take effect. Your continued use of WhimCanvas after changes become effective constitutes acceptance of the updated terms.
